Type 1 in one paragraph

Austin Type 1 short-term rental licences cover owner-occupied and related hosting patterns as defined by Austin rules, where the host lives in the property or meets the Type 1 criteria set by the city. Type 1 is distinct from Type 2, which covers other short-term rental patterns, and hosts must confirm which type fits their property and pattern from current austintexas.gov guidance before applying. A Type 1 licence for an owner-occupied pattern does not authorise a non-owner-occupied pattern, and vice versa.

Type 1's logic is housing and neighbourhood impact: a host who lives in the property and lets part of it, or lets it while away within Type 1 conditions, affects housing supply and neighbours differently from a whole property operated as a short-let business. That logic explains why Austin sorts licences by pattern, and why hosts should describe their pattern honestly at application rather than choosing the type that seems easier to obtain.

Confirming Type 1 fit

Before applying, hosts should confirm Type 1 fit on three points: residence, property and pattern. Residence asks whether the host lives in the property as required for Type 1. Property asks whether the property type and location fit Type 1 under city rules. Pattern asks whether the intended letting, such as rooms, whole property while away, frequency and guest arrangements, fits Type 1 conditions. If any point does not fit, the host should check Type 2 or another lawful route, rather than forcing a Type 1 application.

Evidence for those points should be gathered before applying: residence evidence as the city requires, property details as they appear in official records, and a clear description of the intended pattern. An application with vague pattern description invites queries and may produce a licence that does not cover the actual operation. Specificity at application stage protects the host later.

Applying for Type 1

Apply through Austin's official process described on austintexas.gov, following current forms and instructions, since forms change. Complete the application from the property file, not from memory, checking address, host details and pattern description before submitting. Save the application confirmation and licence on receipt, note validity dates, and set a renewal reminder well before expiry.

While an application is pending, do not list the property as Type 1 licensed, do not display a licence number not yet issued, and do not take short stays that depend on the licence. A pending application is not a licence. Hosts who need income during a pending period should consider lawful longer stays where applicable, rather than short stays requiring the licence.

Listings, verification and platform checks from July 2026

From 1 July 2026, Austin platform verification requires platforms to verify licences and to remove unlicensed listings within 10 days of notice. For Type 1 hosts, that means listings must carry the correct Type 1 licence details, platforms will check them against city records, and a mismatch or lapse can lead to removal within that 10-day window after notice. Hosts should therefore align listing details with the Type 1 licence exactly, and should check platform verification status after every listing edit.

Verification failures for Type 1 usually point to a type mismatch, a detail mismatch, or a lapsed licence. Diagnose in that order: is the licence Type 1, does it match the property and pattern, do listing details match the licence, is it still valid? Fix the source issue, then seek re-verification. Do not create a duplicate listing to bypass a hold, since duplicates are often matched and can worsen account standing.

Operating within Type 1

Operating within Type 1 means staying within its residence, pattern, guest, safety and record conditions as set by Austin rules. A Type 1 host who moves out, changes pattern to a Type 2 operation, or lets in a way that breaches city conditions drifts from the licence, even if total nights are low. An annual pattern review, comparing actual stays with Type 1 conditions, catches drift before it becomes enforcement. Note that review, with its date, in the property file.

Building and lease layers apply to Type 1 hosts as well. A Type 1 licence does not override a homeowners association ban, a condo rule or a lease clause. Check building and lease permission before listing, file any permission with the licence, and align listings and house rules with building conditions. City and building permissions are separate.

Renewal, updates and rechecks

Renew Type 1 before expiry, update the city where residence, property or pattern changes, and recheck austintexas.gov guidance before each season. Keep licence, application correspondence, listing views showing verification, stay logs and building notes in one property file. That file answers most city, platform or building queries without reconstruction.
